Section 1.- In This Code:
(1) "To commit an act dishonestly” means to do an act in order to procure, for himself or the other person, any advantage to which he is not entitled by law;
(2) "Public way " means a land or waterway used by the public for traffic , and includes a railway or tramway used for public conveyance;
(3) " Public place” means a place to which the public has a right of entry:
(4) " Dwelling place” means a place used for dwelling. such as a house, shed, vessel, or floating house in which a human being dwells, it also includes the precinct of the place used for dwelling, whether it be enclosed or not ;
(5) " Arm” includes anything which is not a weapon by nature, but which is used or intended to be used as a weapon for causing grievous bodily harm;
(6) " To commit an act of violence" means to do an act of violence against the body or mind of a person, Whether it be by physical force or by any other means, and included any act causing any person to be in a state of being unable to resist, whether it be using drug causing intoxication , by hypnotism or by any other similar means;
(7) " Document" means any paper or other material for expressing the meaning by letters, figures, plan or an other design, whether it be by way of printing, photographing or any other means, which is evidence of such meaning ;
( 8 ) "Official document" means a document draw up or authenticated by an official in the course of his duty, and includes also a copy of such document authenticated by an official in the course of his duty ;
(9) " Document of right” means a document evidencing the creation, modification, transfer, reservation or extinction of a right;
(10) "Signature” includes a finger - print and mark put to a document by a person in lieu of his signature;
(11) "Night" means the restraint, keeping in custody, detention, confinement or imprisonment;
(12) Custody” means the restraint, keeping in custody detention confinement or imprisonment
(13) Ransom” means a property or benefit demanded or given in exchange for the liberty of the person who is taken away held or confined
(14) Electronics Card means that:
(A) any documents or any other materials in any description, that issuer having issued to the person entitled to use, whether the name specified or not the data or cipher noted by applying the ways or electron electricity, electromagnet wave or any other similar ways and applying the ways of letters, figures, ciphers, identify number or symbols either able to be seen or not to be seen by the naked eyes;
(B) data, cipher, account _ number, any of set numbers of electron or figures which issuer having issued to the person entitled to use by any of documents or materials not to be issued, but there is the way to use in the same manner as (A); or
(C) Anything else to be used in corroboration of the electronic data for showing the relationship between person and electronic data by the object for specifying the owned person.”
มาตรา 1 ในประมวลกฎหมายนี้
(1) "โดยทุจริต" หมายความว่าเพื่อแสวงหาประโยชน์ที่มิควรได้ โดยที่ชอบด้วยกฎหมายสำหรับตนเองหรือผู้อื่น
(2) "ทางสาธารณ" หมายความว่าทางบกหรือทางน้ำสำหรับ ประชาชนใช้ในการจราจร และให้หมายความรวมถึงทางรถไฟและทาง รถรางที่มีรถเดิน สำหรับประชาชนโดยสารด้วย
(3) "สาธารณสถาน" หมายความว่า สถานที่ใด ๆ ซึ่งประชาชนมีความชอบธรรมที่จะเข้าไปได้
(4) "เคหสถาน" หมายความว่า ที่ซึ่งใช้เป็นที่อยู่อาศัย เช่น เรือน โรง เรือ หรือแพ ซึ่งคนอยู่อาศัย และให้หมายความรวมถึงบริเวณของที่ ซึ่งใช้เป็นที่อยู่อาศัยนั้นด้วย จะมีรั้วล้อมหรือไม่ก็ได้
(5) "อาวุธ" หมายความรวมถึงสิ่งซึ่งไม่เป็นอาวุธโดยสภาพแต่ซึ่งได้ ใช้หรือเจตนาจะใช้ประทุษร้ายร่างกายถึงอันตรายสาหัสอย่างอาวุธ
(6) "ใช้กำลังประทุษร้าย" หมายความว่า ทำการประทุษร้ายแก่กาย หรือจิตใจของบุคคล ไม่ว่าจะทำด้วยใช้แรงกายภาพหรือด้วยวิธีอื่นใด และให้ หมายความรวมถึงการกระทำใด ๆ ซึ่งเป็นเหตุให้บุคคลหนึ่งบุคคลใดอยู่ใน ภาวะที่ไม่สามารถขัดขืนได้ ไม่ว่าจะโดยใช้ยาทำให้มึนเมา การสกดจิตหรือ วิธีอื่นใดอันคล้ายคลึงกัน
(7) "เอกสาร" หมายความว่า กระดาษหรือวัตถุอื่นใดซึ่งได้ทำให้ ปรากฏความหมายด้วยตัวอักษร ตัวเลข ผัง หรือแผนแบบอย่างอื่นจะเป็นโดย วิธีพิมพ์ ถ่ายภาพหรือวิธีอื่นอันเป็นหลักฐานแห่งความหมายนั้น
( 8 ) "เอกสารราชการ" หมายความว่า เอกสารซึ่งเจ้าพนักงานได้ทำ ขึ้นหรือรับรองในหน้าที่ และให้หมายความรวมถึงสำเนาเอกสารนั้น ๆ ที่เจ้า พนักงานได้รับรองในหน้าที่ด้วย
(9) "เอกสารสิทธิ" หมายความว่า เอกสารที่เป็นหลักฐานแห่งการก่อ เปลี่ยนแปลง โอน สงวนหรือระงับซึ่งสิทธิ
(10) "ลายมือชื่อ" หมายความรวมถึงลายพิมพ์นิ้วมือและเครื่องหมาย ซึ่งบุคคลลงไว้แทนลายมือชื่อของตน
(11) "กลางคืน" หมายความว่า เวลาระหว่างพระอาทิตย์ตก และ อาทิตย์ขึ้น
(12) "คุมขัง" หมายความว่า คุมตัว ควบคุม ขัง กักขังหรือจำคุก
(13) "ค่าไถ่" หมายความว่า ทรัพย์สินหรือประโยชน์ที่เรียกเอา หรือให้เพื่อแลกเปลี่ยนเสรีภาพของผู้ถูกเอาตัวไป ผู้ถูกหน่วงเหนี่ยว หรือผู้ถูกกักขัง
(14) "บัตรอิเล็กทรอนิกส์" หมายความว่า
(ก) เอกสารหรือวัตถุอื่นใดไม่ว่าจะมีรูปลักษณะใดที่ผู้ออกได้ออกให้แก่ผู้มีสิทธิใช้ ซึ่งจะระบุชื่อหรือไม่ก็ตาม โดยบันทึกข้อมูลหรือรหัสไว้ด้วยการประยุกต์ใช้วิธีการทางอิเล็กตรอน ไฟฟ้า คลื่นแม่เหล็กไฟฟ้า หรือวิธีอื่นใดในลักษณะคล้ายกัน ซึ่งรวมถึงการประยุกต์ใช้วิธีการทางแสงหรือวิธีการทางแม่เหล็กให้ปรากฏความหมายด้วยตัวอักษร ตัวเลข รหัส หมายเลขบัตร หรือสัญลักษณ์อื่นใดทั้งที่สามารถมองเห็นและมองไม่เห็นด้วยตาเปล่า
(ข) ข้อมูล รหัส หมายเลขบัญชี หมายเลขชุดทางอิเล็กทรอนิกส์หรือเครื่องมือทางตัวเลขใดๆ ที่ผู้ออกได้ออกให้แก่ผู้มีสิทธิใช้ โดยมิได้มีการออกเอกสารหรือวัตถุอื่นใดให้ แต่มีวิธีการใช้ในทำนองเดียวกับ (ก) หรือ
(ค) สิ่งอื่นใดที่ใช้ประกอบกับข้อมูลอิเล็กทรอนิกส์เพื่อแสดงความสัมพันธ์ระหว่างบุคคลกับข้อมูลอิเล็กทรอนิกส์ โดยมีวัตถุประสงค์เพื่อระบุตัวบุคคลผู้เป็นเจ้าของ
(15) "หนังสือเดินทาง" หมายความว่า เอกสารสำคัญประจำตัวไม่ว่าจะมีรูปลักษณะใด ที่รัฐบาลไทย รัฐบาลต่างประเทศ หรือองค์การระหว่างประเทศออกให้แก่บุคคลใด เพื่อใช้แสดงตน ในการเดินทางระหว่างประเทศ และให้หมายความรวมถึงเอกสารใช้แทนหนังสือเดินทางและ แบบหนังสือเดินทางที่ยังไม่ได้กรอกข้อความเกี่ยวกับผู้ถือหนังสือเดินทางด้วย"
